Protista is the kingdom that contains organisms that do not belong in any other kingdom. Some of them are unicellular and can carry on photosynthesis. (Euglena and Volvox). These organisms need to be multicelled in order to be classified as plants.

Kingdom Protista is a "catch-all" or miscellaneous kingdom that contains organisms that do not belong in other kingdoms.

Euglena and Volvox are photosynthetic protists. These are not classified as plants because true plants are multicellular with different tissues for different purposes. Euglena is unicellular and Volvox is colonial.

Characteristics of the animal kingdom include:
1. heterotrophic
2. multicellular
3. no cell walls
4. most are motile
5. all have a nervous system except sponges

If it is a protist or an animal, it must have a nucleus (unlike prokaryotes such as Archeabacteria and Eubacteria). Animal cells don't have cell walls, which separates them from plants and fungi. Also, animals are multicellular, while protists are unicellular organisms. Volvox has cooperation between cells, but it is not multicellular (there is not as much specialization of cells as with animals and plants).
