You don't need a doctor's note to take FMLA time off. That's because FMLA is up to 12 weeks of unpaid leave for personal medical reasons or to take care of a family member. If you are expecting paid maternity leave then you should talk to your companies HR department to find out what their restrictions are. Oh, one more thing, if its planned FMLA time you're supposed to give your employer 30 days notice before you plan to take the time off.
Edit: Actually after going and reviewing FMLA a bit further I have to amend my answer. Your employer can choose to have you provide documentation of the reason you are applying for FMLA. Here's a link with more on FMLA: http://www.employer-employee.com/fmla.html

Before you go on FMLA. Get a hold of your HR DEPT. to give you forms to have your doc filled out. With that you turn it back into work.. and then as soon as you go in to labor... it will take affect! Good luck!

I would see if your OB would go ahead and fill out your FMLA papers. Because you can use the FMLA for Dr. appts as well. My husband and I have been dealing with the FMLA issue for a while.
Here is the website for FMLA.

No. You have your doctor fill out the papers afterwards.
