The only way you willlose your kids is by being ruled unfit by the court. The only way for being unfit is having been charged with or have current charges pending of child, and/or drug/mental charges against you. Adultery is a reason for divorce only, not to rule someone as unfit. You have nothing to worry about here. Being with someone else is not right but is not a crime yet.

Who you bring around your kids can make you unfit. Neglecting your children to be involved with another man can make you unfit. Not taking care of your kids financially, emotionally can make you unfit. Cheating does not make you unfit. Remember you are a role model to your children, so don't do anything that will hurt them!!
Before you divorce make sure you have your business in order. The courts will do what is best for your kids. Keep that in mind.

Yes and they should in this case.It's up to both of you to do the right things.If you can't live with him then get the divorce and then pursue a relationship.Cheating solves nothing and only makes things worse for everyone.Get your act together and do the right thing for him and the kids.If you cheat on him it will cause hard feelings in the future plus one day the kids will learn the truth about what happened and think poorly of you.Do the kids a favor and don't mess their life up too.

I think that you should separate the legal way to avoid having your husband use anything against you. I understand where you are coming from because I told my husband that I want a divorce and he does not want to divorce me in our case. He feels like it is cheaper to keep me, He mentioned this too me a few times. But that is so not fair, if you are not happy with someone why should you suffer.. Good Luck to you!!!!

he can use infidelity against you if thats what youre wondering... its hard, but work on getting divorced first, that will also help you get perspective on the importance of figureing out what you really want from relationships and you will be able to focus more on your kids. holding a relationship while youre in the middle of a divorce only makes things harder on everyone involved. lol. i only laugh because i actually understand what im talking about. :)

I think in some states "adultery" is not an issue when it comes to custody hearings..but why put the cart before the horse?...if your kids are important to you then why take any risk until divorce and custody issues are dealt with?

the law is funny when it come to kids,,, in some states, you can not have a live in bf, while you kids are in the home,,,,now if you go out an cheat, you just giveing him ,more reason to take the kids,

You can lose custody. It happened to my cousin, while she was out with her new man and clubbing all night, her children's grades dropped and their emotional needs weren't being met. Their father got primary custody of them and they are doing so much better. If you don't want to be with your husband fine, just don't make your children suffer for your selfishness.

yes they can say your unfit if you cheat why not get a divorce and custody of your kids i didn't love my first husband so i divorced him and got custody of my two daughters and i raised my kids he got vistation

you can't "be with some-one else" until you get divorced,if you cheat on him you could (depending on the state you are in,[american law...i ask you]) claim that your marriage has irreconcilably broken down,& that you only just got with your new man...{but keep dates}.
