We do not have a problem paying the past child support, the money doesn't matter. We are concerned for his daughter. We know he is the father. The daughter is 16. Last October she ran away from mothers house...Her probation officer said that if she is found she will go to a detention center for 2 years. She is listed as a runaway...We are looking for her...last we heard from her was a little over a month ago she said she was in Washington State. Now before she ran away the mother said she wanted us to take custody of her. The mother told the probation officer that she didn't want her and that she was going to give us custody. When she ran away the mother stopped all proceedings for us to get custody of her. Can she legally go after current child support for a child that does not live in her home?

In regards to tmarrie99 you have no idea what you are talking about...I am the 3rd women and it is us we are a team it is not him against her it is not about the money...you see he would have been paying child support the whole time had the mother not ran away with her 13 years ago.....Not every man is a jerk when it comes to responsibility, he had custody of her when the divorce papers were served he told the judge that a daughters place is with her mother there are things that she can teach her that I can not ....that is in the divorce papers.....please if you can not help in this matter do not leave a message.

Legally yes. Your divorce decree says support to be paid ti shes 19 or thru school or something along those lines. It doesnt say it stops for runaways or such. Once found she will be placed in detention til shes 18 and both parents will pay. Once mom said she didnt want her anymore dad should have jumped on this really quick and got the paperwork started before she changed her mind or she ran away. If you have any proof, you can always challenge her in court for remodification of support and go for custody of her since mom doesnt want her anyway, on the grounds that mom forced her to run away from a hostile environment. This will work also if mom goes after support too. Have the courts take away moms custodal rights as an unfit mother and award new custody to dad. In other words make moms hesitation, which resulted in her running away, to reassign custody to dad, work against mom. Good luck

I know this is frustrating for you. Your concern is for her safety and you want to help her. It would seem that the mother wouldn't have the right to go after current child support if the daughter wasn't living with her and especially if the mother said she didn't want her there. Your best bet is to contact a Family Law attorney to get an accurate answer. I hope your step-daughter shows up soon and is safe.

An inheritance DOESN'T count towards income....it's not income. It's a one-time dealie. However, once welfare finds out, she will have to repay all of the public, government assistance she has received out of her inheritance. That is the way things work. Welfare is a helping hand....and if the recipient comes in to a windfall (like a winning a lottery or - inheriting money), the welfare folks will send her a bill so she can repay the taxpayers for helping her out. Now, if you happened to put a bug in the ear of the welfare department, it might happen sooner rather than later. Revenge can be sweet!!!!!

Not here in Pennsylvania, the child is a run away. When she is found and sent to a detention center, your husband and the mother will have to pay the state support while she is there.

She can Not go after child support when the child isn't even in her care. If she were to persue this in the courts..and they find out she's not even living there, the case will be dismissed*

if the child live with you no. if the child lives with her yes if the child runs away from her then yes, she is still responsible for her.

Why is it that it's always the second woman in the father's life who is SO SO concerned about the cash?
HE needs to man up and take care of business. And that won't happen here.
