As per the UAE labor and immigration law, you can not able to join with the new company on a new visa. The law stipulates that if an employee overstayed out of UAE for more than six months his/her residence permit will be cancelled automatically and imposed a ban for one year from the date of cancellation (remember, not from the date of the last departure from UAE).

In your case you have to get cancelled your existing visa PHYSICALLY, whether it is valid or expired. I wonder how you can send your passport back to your former employer. Try through an agent or somebody reliable and don’t send directly to your employer, may be they will not return your passport quickly.

Once the cancellation formalities are over you can try to enter to UAE on a visit visa.

Try your best, good luck.

Although I work in Oman, I am aware little bit about UAE laws. Since you have been away from Dubai for more than six months, as per immigration laws, you cannot travel to Dubai on same visa. Your employers should have cancelled your visa with the immigration at the end of six-month period. If not, they can do that now, so please call them and find out. Depending on the relations an employer has with the immigration, original passport is sometimes asked by immigration and sometimes cancellation is done without. Your employer should be influencial to cancel your visa without the original passport. If not, you are in a limbo!

Please NEVER send your passport by courier or thru some friend, as it is illegal, unless a particular courier company is authorised by a country's embassy to carry passports for visa purpose. If the courier company looses your passport, or your employers decide to keep your passport just to harass you, you will be in trouble to get a new passport.
