well i want to move back to greece and my dad took away my passport claiming he was the one who paid for it and if i wanted to leave to go get my own.Is that legal?what can i do to get it back?Should i file a stolen passport and get a new one??

No. It could be considered as theft/larceny. Since it is your passport, you own it. Because it is yours, he has no right to retain it.
Larceny is defined as the taking of a tangible, personal property of another person with the intent to permanently deprive. Sounds like your case fits these elements.

Regardless whom paid for it ....
It is Your passport.
If the Passport is Valid ...another one can not be issued.... unless it is declared lost or stolen.

You are now a LEGAL ADULT ...and he can not keep your passport from you .... Even though he may have paid for it.

The passport is in your name.

Contact your local police ....they Will tell you the same thing. Your Father has no right to hold your passport.

If the issue is money ... Return the amount he paid for the passport.

Yes. Since you are over 18, and you are legally an adult, it is YOUR passport. Technically, you could actually file for a stolen passport. However, this would put you and your father in a huge legal mess.

If you are 18 he cannot legally confiscate any of your possessions, never mind government ID. You passport is yours. Sure, he paid for it, but all that means is that he paid for it, not that he has any legal ownership of it.

From the sounds of it, you're not going to get it back without a fight. So just report it lost and get another. Don't report it stolen unless you're willing to report your father as the thief.

Yeah just file for a stolen passport and get another you are 18yrs old, just make sure your being responsible, do you think your father may just be looking out for you?

You are old enough so here goes. Go to the Greek consulate and tell them your story. You might get it replaced for free or at least a small fee. As to being legal who knows. Just get it and go. You will find it in the phone book or on line

it really depends on the legal age in your area. some places are 18 some are 19 and some are 21. you could call a lawyer and ask them for sure and then they could tell you what to do to get it back if you are of legal age.
