I have been very sick since Tuesday and I had to miss 4 days of work. I went to the doctor and she has excused me for 5 days, with a doctors note can I be fired?

I did not have a migrane. I had a stomach virus and chest infection. I tried to go into work today and my boss told me that I did not look good. She asked if I was going to make it through the whole day and I told her probably not. Then she was like then you should just go home. Also I asked her if I was going to be fired and she stated don't worry about that, if you are sick your sick.

Some good and bad advice has been given here. Yes, you are an "at will" employee. However, you are also an American citizen (I assume) so you are likely protected by the Family and Medical Leave Act (FMLA). There are several requirements, so check out FMLA on the federal government Website.

There is a great article in this weeks issue of BusinessWeek. It discusses how difficult it is to fire an employee today, even employees that underperform. Grab a copy and see if anything applies to your situation.

Read this very carefully and never forget it. Are you in a union or have an employment contract? Probably not, then you are an employee at will. That means you can quit and they can fire you at any time for any reason or no reason. Now if the company has a written policy, and they choose to follow that policy that might provide some guidance.
You need to talk to your manager and find out if it is OK for you to miss work. Good luck

it depends on company policy.
if you don't have that many 'sick days' earned
or 'leave days' earned to cover it you can try to get
leave without pay (lwop).
Think about it lets say you had a doctor's note that said you would be sick for two years. Yes, they can fire you if you can't come to work for two years. Because they need to have the job done.

In many states they have "employment at will" statutes. This means an employer can fire you for no reason whatsoever without any retribution.

So the answer is yes if you live in an "employment at will" state and yes even if you do not (but the employer can be sued). Do not assume if you sue an employer, you will win.

Probably not. Depending on your situation, though, your employer can probably withhold pay for those days. Hopefully you CALLED them and didn't just not show up. THAT they can fire you for.

This obviously didn't stop you from answering about 30 questions on Yahoo answers. Hopefully your migraine is better.

is this all verbal or written in e mail. This seems such as you may deliver it as much as courtroom in the event that they hearth you yet label you layed off. maximum unemployment reward won't even commence till you have labored 6 months or greater continuously (in case you labored at a various activity previous to this, it counts as working). If that is in e mail, save that e mail and then in case you get fired, communicate on your state branch.

As long as you have a doctors note they cannot fire you for being out of work. They can however find another excuse if they really wanted you fired.

If you're a hooker, the answer is a resounding 'yes'. Nobody likes a sick hooker...it's bad for business, and well...just gross. Even if your doctor gave you a note, the fact that you missed 4 days means you probably have a few STDs.
