A job opportunity was offered to me by another company in January with a healthy salary, my present employer said that they will match the salary if I stayed with them which I did. I was paid the new salary since February. Today (20.04.07) they are reducing my salary by £11K starting in May because they cannot afford me (so they say, even if the company is doing well). My performance is still at the top, nominated best sales person for year 2006 and I am still the highest performer. Do I have any rights? and what are they? Thank you all for your help.

To do this without your consent they have to terminate your contract and give you a new one - they can't just reduce your salary. What you need to do is write to your manager (copy in the HR Manager if you have one) and confirm in writing that you do not agree to the change in your terms and conditions and that you will not agree to having your salary cut.

My guess is they will make you redundant, which means that they will have to pay you your notice period and any statutory redundancy pay you are entitled to. If they say that they don't care, they are just going to do it resign straight away. In your resignation letter state that you are resigning due to their breach of your terms and conditions, stating that they have made it impossible for you to continue in their employment. Then get yourself off to a no-win-no-fee lawyer and take them to an Employment Tribunal.

I'm afraid it looks like you are going to lose your job over this one way or another, its just what kind of settlement you get on the way out that's important now.

When companies are hurting financially they can do this as they have too, not that they want too. Many companies in America have confronted their employees with a choice, Take a cut in pay or some will need to be laid off, also, I have seen an early retirement offered. If, it a good company they try to work with the employees so this situation works for everyone involved. There are a lot of circumstances involved.

Are you a member of a union? Presumably there are other employees in a similar situation?
Your company would have to terminate your current contract to reduce your salary. To do this they MUST give you written notice - have they done so?
Either way, your union will be able to take them to the cleaners at an industrial tribunal. (If you are not a member you'll need to make arrangements yourself.)
DO NOT resign your position until you have sought advice on this matter.

What country do you live in? Laws vary from country to country.

In the United States, you might have some recourse because the employer would have to show that everyone's salary was cut at once and you weren't singled out.

No, not unless you change roles or agree to the new salary. Basically, they cannot change your terms of contract unless it is with your consent.

You probably don't have any rights at all.Your company can probably do what they like.Your only right is to piss off and leave them to it.
