Since I can't see the judge in the photo in that article, I can't judge who was the bigger ............. donkey.

So, someone has provided it! May I answer by saying I'm glad you asked the question, because I really got a"kick" out of the article. (No pun intended.) Good for the judge to bring in Buddy as an EXHIBIT to prove what a mild mannered animal she was! The person who wrote the article also, in the first paragraph wrote: "...not the loud, aggressive animal HE had been accused..." & further down, I was confused by "..surrogate mother." Anyway, I think it's very whimsical!

I'd have to see court documents labeling the donkey as "a witness" to believe that's what happened. I suspect he was accepted as an "exhibit". I suspect the judge was well aware of the requirement that a "witness" testify under oath, but it wouldn't surprise me to learn that a reporter had no clear understanding of the difference, or knowing the difference printed the story that way because the truth wasn't nearly as much fun.
