It is possible - anything is possible with the court systems- but it is unlikely. Someone may have missed a confirming hearing or failed or not known to sign some paper. States differ in their laws but in some states papers are signed and filed but then there is a waiting time and then the ppl either have a hearing or both sign again. Some do it yourself divorce kits do not make this clear. If a lawyer was involved the lawyer should have let everyone know exactly what was needed to be done but lawyers are not failure proof. We opened the newspaper one day and found out our lawyer had just been busted for selling drugs, no wonder he was always too busy to talk to us. The clerk of the court where the papers were first filed may be able to tell you what you can do now. If you used a lawyer the lawyer should help straighten this out. If you used a lawyer and the lawyer does not help now you can contact your state's bar association and report this and see how they can help.
If there was a marriage in that year when the ppl thought they were divorced and were not that marriage is not legal and the ppl will have to get married again if they want to be married. There may be a need to go straighten some things out with the marriage license bureau so no one gets accused of giving false statements that they were free to marry if it really was a mix up and not a deliberate thing. Any child born in any second marriage during this time will need to be legitimized and paternity established. Each state has somewhat different rules about how to do this. The family court or superior court can tell you and the department of child and family services should be able to also. As it stands if either person married again in this year that they were not divorced they could be accused of bigamy so if it is a mix up it needs to get straightened out.

That is very possible. When people want a divorce, they each need to get a lawyer. After paperwork is signed that they want the divorce to go forward (both parents need to sign on this), the paperwork will then go forth to a Master Lawyer. When the parents meet with the Master Lawyer, they will need to agree on how everything is split 50%-50% (property, house, possessions, etc) or they may end up having to go to court if they cannot reach an agreement. In court, they will basically be fighting for anything they can get their hands on, and court fees will soar.
If the parents have not gone to a Master Lawyer and finalized everything, they are not legally divorced. They are legally Separated, but not Divorced.

If two people file for divorce, they'll know for sure, and without a doubt, whether or not it "went through." The court will issue a decree of dissolution of marriage, and each party gets a copy. Until such a decree is issued by the court, they're still married.
I cannot think of any circumstance where at least one of the parties isn't fully aware of the status of the marriage at all times. The only way the other party wouldn't have knowledge of it is if the other party either was unable or unwilling to read the communication from the courts.

No that is not possible unless both people moved and never put in a change of address, even then it's extreamly odd.
In a divorce you go to court and the judge tells you rather or not the divorce is final, then you get the papers in the mail.
I can not see how a person would not know they were divorced or not.
were you in love with some one who said they were divorced, and now all of a sudden says they are not divorced? because that is one of the oldest tricks in the book to dump some one with out hurting them entirely, because then you get tired of waiting and move on in time.

Yes, I have heard of this. I think it was really the lawyers fault -- that they didn't file the final papers with the court. Check at the courthouse to see if your divorce is listed. Otherwise, you're still married.

Well, i have heard about it happening, but never happened to anyone that i know. But it could be possible. Could have been a very irresponsible over-sight on the lawyers side, or the spouse could have done it on purpose. I'm sure there are other reasons.

I wouldn't think so. Are these people using Lawyers? They should have been told of the hang-up...whatever it was. And the lawyers should have got it fixed and moving again.
