Each state defines its degrees of offenses differently. Here for instance the assaults are all seperate and distinct crimes from the criminal sex charges so that's just plain incorrect. You should be able to go to a library or hit the web and read your state's statutes that describe what they classify as 4th degree.

4th degree assault always involves sexual contact. The contact must be accompanied by any one of a number of aggravating factors. Contact includes touching the groin, genital area, inner thigh, buttocks or breast or the clothing covering these parts.

In Washington State it could be as simple as spitting on someone.
