Basically, I got in an accident, and rear ended a guy, I am a broke college student and am going to represent myself. No one was hurt and only my car suffered damage, I could pay off the ticket for 85 bucks, but would get DMV points. I really dont need to pay extra on my insurance!! Does anyone have any suggestions on what I can do in court to get this dismissed! PLEASE HELP!

Plead no contest,ask if you can take a defensive driving course,and wear a suit and and a tie.None of these things will eliminate the ticket and costs,but should lessen them,The suit and tie really help.

There really isn't much defence for tailgating. If this is a first offence, and the opportunity exists to take remedial driving course to eliminate the points, you can explore that option, but make sure you are really going to learn a lesson from this. Tailgate again and somebody could be seriously injured. Some states are bringing in minimum $2500 fines, so that should show you how serious your offence really was.

You will NOT get this dismissed! The best you can do is get 50% taken off, but the points remain on your record for three years. If you are seriously trying to get this dismissed, get a lawyer, pay the $500 retainer, then go to court and roll the dice. From experience, go to court, cry, then pay the fine. Move on with life.

The reality is that you are fighting a loosing battle. You rear ended the guy. Therefore, by definition you were following too closely. You really don't have a leg to stand on.

Take responsibility for your mistake, pay the ticket, and be a bit more cautious in the future.

See if your state offers a class to keep points off your lic. I know Florida and Ohio do but not all states offer it....if you complete the class and turn in your certificate the clerk of courts they do not put any points on your lic....

that is your best bet cause you are fighting a losing battle on that kind of ticket...the driver from behind is ALWAYS considered at fault...you are wasting your time and money taking it to court....Good Luck

Does your college have a law school???
if so, mnaybe you could ask a professor of law to help you.
