First of all, this is not a stupid question. The reason why i asked this is because if that person is illegal, why should they serve time in jail in a country where they are illegal? I am just asking what they all do since i had a relative killed by one!

The drunk driver should be given a fair trial (I'm not saying be released). He should be punished for his actions just as any other U.S. legal resident or U.S. citizen should. After, and only after, he has served his time he should be deported and flagged. If he enters the country illegally again he should be arrested and imprisoned.

When in Rome..., in other words, they are subject to our laws and in most states a DUI involving a death is prosecuted as Intoxicated Manslaughter. After he serves his sentence, they need to turn him over to Immigration Officials for deportation and flag him as an undesirable alien, not eligible for legal crossing or entrance to the US. There are two separate issues here, the DUI involving a fatality and the immigration status. Both should be handled independent of each other. His punishment for Intoxicated Manslaughter should be the same as if he were a citizen and his deportation and classification as an undesirable alien should be consistent with any other illegal alien that has committed a serious crime in the US.

I think the question shouldn't be about being legal or illegal, but drinking and driving. The illegal part is another crime. Each crime should be dealt according to the state laws and regulations. but in california, they let you go after you sobber up a little. I think the punishment should depend on the amount of BAC.

Lets see. an illegal drunk driver recently killed 2 girls in Virginia. He had previously been stopped and charged for driving without a license, identity theft and a few other crimes. But he was still out of jail, getting drunk and driving.

After he killed the girls, he said he would willing leave the country.

They should get the same treatment a legal citizen would get. They did commit the crime here so they should serve here, but a legal citizen drunk driving wouldnt justify the act of drunk driving just because theyre "legal", so it should be the same.

They should serve whatever sentence the court hands down, then be deported.

And even if no one is killed drunk drivers should ALWAYS be run for immigration checks. If illegally here, after their sentence (or before if it is non-custodial) they should be deported.

In areas where localities are running immigration checks on drunk drivers, drunk driving has dropped dramatically, per press accounts.

I think that drunk drivers should be charge with First Degree Murder. The reason is that drinking and driving is wrong. Therefore, here is the premeditation.

They should sentence life imprison or long prison sentence with hard labor.

They face the same sentencing as a US citizen and then are deported after they finish the sentence. In rare cases, they serve some or all of their sentences in their country of origin, often because they are wanted for crimes there as well.

I think most drunk driving cases are charged as manslaughter.

Yes , sure. They can vote with a driver's license so they should serve time here in a jail and then deported. The crime was committed here, so they should do time here.

First off, they should be put in jail because they are illegals.

Second, they should be prosecuted to the fullest extent of the law, for being a law breaker, (they cant own a car, so it must of been stolen, they are in here illegally, and they killed some one, all enough to put them behind bars for 40 years I would say!).

Anyone who kills a person while drunk, should be sent to jail for at least 40 years in my opinion... There is no excuse for that, drinking and driving and killing some one.
