I had a friend write me a check and I believe it got returned for insufficient funds. If he refuses to pay the amount, I understand he is still legally liable for the amount he agreed to pay me on the check. Where would I file a case if he refuses to pay? Do I need to go to small claims court or can I file it with some sort of district attorney?

Also I made him sign and date a paper saying "I agree to pay John Smith $450 by personal check on or before April 13th, 2007" Can I call my local police and just report it stolen or what can I do? Thanks.

Your local cops would be the first stop. They'll write him a ticket for "negotiating a worthless instrument" or similar term, and then the court will take over from there. They'll let you know his court date and all you have to do is show up. Some friend huh?

I'm assuming you live in the United States. You have two options. First, yes you can file with the D.A, but it's a pain in the **** and they really won't go after him, unless he's done this before for big dollars. Go to small claims court. If you win he has to pay you. He can still tell you to piss off, but you then can go to a collections company and have them call him everday and put a stain on his credit. no sure fire way of getting your money, but it'll feel good knowing he's getting called at all hours and have a nice little smell on his credit report.
