I would like some specifics about divorce laws in South Carolina. I want to divorce my husband, but I have heard I must be separated for 12 months. Is there any way to make it less time? Someone said adultery, but I know he isn't fooling around. If I said I was, what would be the consequences?

According to SC law an immediate divorce can be issued for adultery, physical cruelty, and habitual drunkenness (including the use of narcotics). Otherwise the two parties cannot have lived together for a period of one year.

Application of these laws may actually differ. Contact a local divorce/family law attorney.

As far as I know it is 12 months. If your marriage has been over for a period of time and you and your husband can agree on a date that you consider your marriage to have ended when you file for divorce you can put that date as when the marriage was over and that you just co-exsisted with each other for the remainder of the time and most of the time the courts will allow that. Personally, I wouldn't admit to anything I didn't do in a divorce because yes it can come back to bite you in the a**. I hope this helps a little. Good Luck!

Definitely dont want to lie to the courts. Itll come back to haunt you for a very long time. Check with the courts and see what exactly the laws are and if there is any way to speed up the process. You can always move to a state where the residency requirement is 30 days or less and then file for divorce there. Good luck

I don't see what the difference is. Most of the time you have to wait 12 months. Unless you lie and your husband does not mind you lying to get the divorce. I am not saying for you to lie. I have known people that lied to get the divorce.

Pergery is a felony in any state. Irreconcilable differences or check into no fault divorce...
