I have a 95 eclipse gsx auto that the tranny had gone out. I took it to a shop that was reccomended to me by another reputable shop. When I first went to get my job qouted the mechanic had told me he could get it done in 3 days & for $1200 I said no way & decided to repair it on my own. two days later I decided I didn't hae the time & went back & he told me it would be a week I said ok.I left the car with the hopes to drive me car in a week. The week came & went & the shop had not even started on my car because he said that my lug nuts were a special kind & needed the proper key.I don;t understand why he took a week to tell me this but i said ok take them off however you like.To make a long story short it has been about a month & a half & he still has not gotten the car right yet.The speedo doesn't work & the reverse is messed up to.After repeated trips he tells me he did not replace the valve body & to come back again I don't have time or patience & the tranny is slipping again.

Assuming that you have a repair order stating what work was to be performed, you have a case.
Furthermore, the valve body is part of the rebuild.
Your best avenue to pursue at this point is to take your car to another shop & have it checked out again, & get a written estimate from that shop. You will most likely have to pay for this, but you can add it on to the price when you take the first guy to small claims court.
That's right, small claims court. Make sure that the second shop you go to is ASE certified.
If the first guy tries to contact you to "make things right", tell him that he had his chance. If he calls you again, tell him that you're going to file a harassment charge against him if he calls you again.
It only costs about 25.00 in most places to file a small claims complaint, & you do'nt need a lawyer, just make sure that you have ALL of your paperwork in reguards to the repair in order when you go.
If the other guy does'nt show, you win automatically, & there will be a judgement against him messing up his credit.
Hope this was helpful, good luck.

Hi -

I would definetely ask for a big refund. If he refuses, get in contact with the owner, or someone way above the guy.

But, deal with people with patience, and a great amount of respect. If you come out angered, and frustrated, and threatening anyone, you will most likely receive nothing. Just let them know the situation very respectfully, and ask everything nicely.

If you don't get what you want, nicely tell them "you know, I appreciate the time you have took to let me explain the situation, and unfortunately, I do not agree with your decision. I am going to take you to small claims court, in hopes that I can get my money back, because I really need it, and I don't think the service was fair at all". ANd then, take them to small claims court. Document everything, and make sure to save all paperwork.

Good luck, and hope everything works out! THe best the to do though in general is to treat people with respect. Have integrity and they should give you what you want!

No, automobile earnings from individual dealers are consistently "as is". It's an unlucky twist of fate, however it isn't your predicament. To explain a prior reply. There is not any "three-day correct of rescission" legislation in any state that relates to automobile earnings. Even if there have been, it would not follow to a individual-social gathering transaction. California presents an non-compulsory correct to cancel, however applies to automobile purchasers simplest, and also you have to pay additional for it. If this individual desired to press th predicament and take you to courtroom, she could ought to end up you had previous talents of the transmission predicament. Honestly, that is the danger she took whilst she purchased a automobile from a individual vendor. That's simply the way it is going regularly.

tell the guy you are fed up with his incompetence and you want a full refund. If he doesn't come through go to the better business bureau and lodge a formal complaint. You can also sue him in small claims court. It only costs about $50 where I live. He will probably wet his pants when he gets a notice to appear in court. But first go to another shop and have them evaluate your problem so you have a professional opinion to back you up in court.
