Sounds like you have a very broad interpretation of sexual assault! If he exposed himself to you, that is a crime, If he touched you inappropriately, meaning forced himself on you and tried to penetrate you with his penis, ya that'd be a crime. If he did penetrate you that'd be a crime but looking at your chest doesn't exactly constitute a criminal act and "I'm sure I felt his penis brush against my back" doesn't exactly sound like he exposed himself to you or that you are really sure that he contacted you at all. Anyhow, if the guy gave you a feeling that he was some sort of sexual predator or made you uncomfortable by his actions, report the date, time, train number, what stop he got on at (if you know), what stop you got off at, and a description of the guy to the transit authority. They don't have anything to prosecute at this point, but maybe they'll keep an eye out for this guy and you might be preventing him from going any farther with anyone else. Other than that, deviate your own routine in case he's a stalker, don't use the same stops and times all the time and stay alert of your surroundings. Stay Safe!

You can't be changing your story and expect to win any case. First you sound offended and later you sound like you almost liked it. You can't have it both ways. Second, unless you have witnesses that can back up your story, or evidence that the assault took place, you won't be able to win anything. Consider that you were on a crowded train and people are brushing up against each other all the time. To cry that he touched you is only going to raise the response of "so what". I assume from your words that he was clothed and not exposed. You don't have a photograph or any semen deposits. You don't have any eyewitnesses that can testify to what he did to you. You don't have a case. It is your word against his. Even if you are more believable than he is, it won't be enough to convict him of anything.
My advice to you is choose your modes of transportation more carefully.

I don't know if the police could do anything, but if you call the train authorities and put in a complaint it will alert them to a problem and they might be able to add more security.
Only an idea, and the people in charge will be informed and then keep a record of when the call was made,(date,time) and who you talked to. This will help if anything comes of it or does not .

First, it depends on your local state laws. Example: Illinois has a clause that basically says that you have to warn the person after the first time and if it happens again, then you can take action.
Second, I hope you got his name or address. Their are 298,444,215+ persons in the US, you know who you are, so their is now only 298,444,214 to complete a police lineup.
