My ex use to pay 44.80 a month in child support . Now due to his new playmate that he seen he has cut paying child support and told every one that he his backrupt.
court will not touch him due to this.

Take him to court anyways. Child support shouldn't have anything to do with bankruptcy. That child is his responsibility no matter what. If he doesn't want any of the responsibilities I would put in a request to have him sign his parental rights away to you. That will leave the door open for a future spouse to adopt.

$44.80 a month? Is this an amount set by the courts, or you as individuals? If it is the courts- go to the child support office in your area- and tell them you want to open a case to have his wages garneshed out of his paycheck. where they will collect the support for you.. going bankrupt will not change this- him telling everybody the courts will not touch him because of this- he's full of it- get what you have coming to your child.
one more note: if this was court ordered- this amount will continue to accumulate- and will be backpay..... If you can get the child support office to do this for you- they will also collect your backpay at a certain percentage.

If he want's nothing to do with the child, then have him sign a paper saying he gives up his parental rights and then you don't have to worry about it. I know that $44.80 comes in handy sometimes, but the child would be better off if his parent doesn't want anything to do with him. That would cause a lot of psychological damage to him in the future.

Contact family services and take him back to court. Maybe he says that he has filed bankruptcy to everyone but that is just his word. If you take him back to court he will have to show proof of the bankruptcy. I am pretty sure that just because you file bankruptcy you are let off the hook for child support. If you were ordered to pay it you are responsible for paying it no matter what your circumstances are. Where do you get that the court will not touch him because of the bankruptcy? Is he the one that told you that? Don't believe what you hear from him or anyone else...get legal counsel instead. They will know what to do.

He had a hand in making this child and regardless of whether he wants anything to do with the child he's needs to pay. Take it to court. He doesn't get out of supporting someone b/c he doesn't feel like it.

Is this amount for arrears that is owed or this for current child support? If this is for current support, ask for a modification to have support increased each month. If he has filed for bankruptcy, the bankruptcy courts prohibit certain types of enforcement against him (license suspension, contempt actions, etc) but that would depend on the state that you live in. You need to contact your attorney. Someone cant just cry bankruptcy's they'd have proof this to the bank.

44.80 a month thats so low , not even a 1000 dollars a year.

for a start he is still getting money each week. im sure that even though he is bankrupt it doesnt stop him paying child support i personally would take his butt back to court your child still has to eat !
get in touch with the child support agency explain everything my ex was trying to get away with out paying i explained this to the child support and basically they told him tough your child you must pay

Is $44 worth it to deal with a deadbeat loser? Yes, you can go back to court and fight tooth and nail for this meager amount, but wouldn't your time and energy be better spent trying to build a good life for yourself and your child? Even a crappy job will give you $44 in one day. Is it worth all the stress chasing your deadbeat ex down?
