This is what I think. What ever the couple earned during the marriage should be split down the middle.
What ever money or property they had before they got married should remain theirs.
Seems the fairest way to settle a divorce in my opinion

Well, the reverse is also true so let's not forget that. I think it sucks royally when a man makes the money and the woman stays at home to raise the family & take care of the house and then when the man wants a divorce, he feels he should not have to split it because she didn't earn anything.........
When you get married, you become a team. Assets become combined and future items, property and money are accrued. It only makes sense that this should be split if a divorce occurs. Why is it the 'man's' property and money and not that of the family???

hey it works both ways, in the event of divorce, the man gets half the women's property and money. Constitutional protection of a man's property, right, Ben Franklin wanted that as line 8.....

This doesn't always happen, my mom just went through a divorce and kept the house that she had before the marriage but also kept the second mortgage that 10 years ago paid off all of his debts. He pays nothing. I think that sometimes it depends on ability to take care of yourself financially...a lot of times women sacrifice the time building a career to take care of the house and family but if that's not the case I don't think its fair for the man to pay all of the time.

Don't blame the system. Blame yourself for getting married. Everybody knows this will happen if you get divorced, so why act like it is a big shock. Don't try to cross a river when you see alligators in it and then wonder why you're missing a leg when you get across.

I agree with you.
What ever aquired BEFORE the marriage should go back to the original owner...anything AQUIRED DURING marriage whould be split in half.
Some women just "think" their puzzie was worth that much when the fact is, there are women who will give it out for free....so it kind of negates the value of it! LOL!

I personally think it should also matter how the marriage ended. If someone was cheating, etc. I think they should be penalized. I don't believe they should be entitled to 1/2.
My first wife got 1/2 even though she was having an affair on me. Nothing I could do but watch it go!

its called prenuptual agreement....in the event that your getting married and dont want your wife to take your stuff if you ever get divorced...then you sign the paper before you get married..that way you leave with everything you put into the marriage at the begininng and everything you guys earned together you split

That is simple to answer. She gets half because she owns half. Weather she bought and paid for it or not.
I work from home and make half of what my husband does but by working at home I save us child care cost, allow him to work everyday without worry. I take care of the house, bills, kids, cooking, laundry and other "wifely" things. If I were not here to do those things either he would or he would have to pay some one. He may earn more than I do but I save him more than half his income.
You might also look at it in another light. The woman may make more than her spouce but in the divorse her husband will get half. It works both ways.

the only way you can protect your assets is the prenuptial but no otherwise you marry to share your life and assets....but just like my ex he had somethings that he came into the marriage with and I did return them....
