I was at a fast food resturant last week and ordered a burger and some onion rings. I don't usually look through my food before I eat, but for some reason something was telling me to look through my burger. I took off a piece of lettuce and it had something on it that looked like a piece of the burger. After looking at it closer...I found out that it was a huge, dead spider. I didn't think about anything else but to take the food back up there and get my $1.30 back. A couple of days later I was telling my friend about it and she said that I could have sued. DANG!!! "You're telling me that I could have walked away with thousands instead of $1.30?" So I wanted others' opinions to see if she was right. There's nothing I can do about it now, but mind you I did have a camera on me at that time and could have taken pics for evidence (but I didn't). Thanks for the help.

actually you would have wasted your time by suing them, the reason why is that no physical harm was commited, everyone wants to sue these days,and most cases get thrown out of court, therefore wasting your time and money, what you should have done is talked to the manager, most of the time they will go an extra step to make it worth while for you. and then of course you need to let the local health board know what happened...stuff like this happens a lot more than most people care to think,..always check take out food for hidden objects, especially oriental food, i shudder to think about some of the things i have found. happy eating..

Lol, that's funny. A huge, dead spider. I've never had that happen to me before, thankfully! However, I probably would have filed a complaint, like others before me have commented. I'm not sure if suing would have been worth it. You might not have won in the end. So yeah...next time, just tell the manager and maybe file a complaint.

What would you have sued for? Being grossed out? As someone already mentioned people have been scamming places lately like the people who put the finger in the Wendy's chili, so it might be your word against theirs. Most people who successfully sue, sue for damages, like the women who was burned by the McDonald's coffee, or someone who was sick and hospitalized from food they ate. Sounds like it was on the lettuce or most likely a prankster in the restaurant placed it there. It would be nice to have gotten that person fired. Next time complain loud and clear in front of witnesses if you want action.

I work in restaurants, the most they are going to do is give your money back and apologize. It is hard to prove that you did not do it yourself, trying to scam them. You would have to prove that it is something that happens on a regular basis in most cases. Most of the stores I have worked at, will try and fix a problem like that. They will have a pest control company come out and check. Which is all they have to do in court is to prove that they have done all they could to see that it does not happen again. Have you never had a bug in your house. Everybody thinks it is so easy to sue, and win. It is not, I am a legal assistant, it is just a waste of taxpayer money and the courts time. You got your money back, now just do not visit that establishment anymore.

That's NASTY! I would call the health department on them! Cause just think if u didn't look at Ur food and u would of ate that Burger and got sick really bad or even died form it!

That is digesting. I would go to the Health Department and report that. That place needs to be inspected. That is why it is so much better to eat from home, than some food establishment.

I would still report them to the health department. That is disgusting. I work in fast food and we have NEVER had anything like that happen at my store. It is lack of cleanliness that causes mistakes like this and they need to be checked out.

you have to file a complaint and talk to the health department, this place should be checked out.
you have to be more positive and do some action towards it , you might have eaten it, or it can happen to someone else.
I don`t think that seuing them would be of any use

You want to call the manager and the health dept. to file a complaint. Hopefully you remember who gave you the refund back and they can ask that person about it too.

call the health dept, one of the employees is one sick character and needs to get their can reamed out.
