(Note, this question is NOT about whether the law is right or wrong ethically - that's a different question). But instead, I'm asking about the new Supreme Court Ruling about the ban on partial birth abortions: http://news.yahoo.com/s/ap/20070418/ap_on_go_su_co/scotus_abortion

It appears that certain states have previously ruled on whether this this procedure is constitutional or not. So, in light of the supreme court decision, will it be thrown back to the states to make decisions or will federal law supercede any state issues?

Amis, I'm going to disagree with you. When women worry about this being a loss of their rights, they are forgetting that there is another life form that is being denied their rights in the process.

This only restricts a specific procedure that is very unethical. It's more than just an elective surgery, it's terminating a life form!!

If you read the opinion of the court, it is fairly obvious that they will not overturn Roe V. Wade. This is a token gesture that will not reduce the number of abortions, just the type of abortion proformed.

Due to this decision we all, all the woman in this country have lost our right to do what we want with our bodies. As far as I know a fetus is not a citizen of this country and does not have rights. I was very, very sad and angry when I heard of this decision. It's a large step backward for women's rights.

What right will the court take away from woman next? How can somebody else made a decision on what I can do with something growing in my body?

This decision will not stop or lower the numbers of abortions at any stage, just make people seek, now illegal (thanks to this decision) ways to get the procedure done, ways that are unsafe!

There should not be any law on this subject, for or against. It is my choice if I want a required or elected surgery, no one elses!

I just left this posting and read through the whole court decision. This decision only put rules on partial birth abortion, it does not make partial birth abortion illegal. This is a political nightmare! What a waste of tax payers money! What a abuse of the power of this administration!

Depends on the next election. The problem is the double standard that it sets if legalized. The taking of a life, whether before birth of after is to close to the thin line. The method of crushing a fetus's head and bones is dramatic and in a sense, murder. It may fall back on the states, but I personally don't think anytime soon. The federal gov. will battle this for a while.

the ruling is federal that supersedes State law.
the only thing that can change what the united states supreme court rules is the united states supreme court. In other words, if at some point we elect a president that puts liberals on the
bench of the supreme court they could over turn what this supreme court ruled. but as long as we have a Conservative supreme court the ruling will stand

This is hopefully the first step in a series of abortion restrictions by the Supreme Court which will eventually lead to the correct conclusion that abortion in any form violates the rights of the fetus. To hell with the "choice" of the mother.

The Supreme Court will define a human as any being beyond the point of conception, with its own separate DNA.

After that, in order to make this murder legal again, Congress will have to pass an amendment making the murder of fetuses legal.

Good luck getting that passed.

This ruling sends partial birth abortion back to the States.

Federal Law ALWAYS supersedes any state laws.

This is a states issue, we should all know by now that once the govt. gets involved they ruin it.
