My 17.5 year old son showed up at my house last night... my ex-husband and i have joint-custody but he has physical placement. My son does not want to go back to him. If i send him back, he's just going to run away to somewhere else... what do i have to do to get physical placement of him? what are my options?

at his age do i even have to do anything legal-wise? is he old enough to just say that he wants to live with me?

my son is a good kid and tries hard but is punished and mistreated and verbally abused at his fathers house.. he doesnt do drugs or rebel or anything... im very proud of him... his fathers only concern is to punish him for trying to escape... last month he was to the point of suicide... he doesnt want to hurt himself again... he just feels like he would be happier with his mother

If you can get the ex to agree. then you would have to do nothing legally, and as he will be an adult in 6 months I cant imagine your ex demanding he return. Legally your son is well over the legal age where he can decide where he wants to live.

You should just contact your ex and let him know your son is staying with you. Or you can contact your child support office (if you have an order) first and request a meeting with the family court commission for your county. If you're paying child support to your ex,the court commissioner end your order. If you have joint custody there is little your ex can do to fight you on this--most courts will not address the situation due to the fact he has 6 months until emancipation.

If you & your ex agree, then nothing really needs to be done. He can just stay with you.

If your ex objects, then you should take it to court, asking for a change in his physical placement. Your son will probably have to explain why he wants the change, to the judge. The judge will then decide based on what he hears from all three of you - keeping the best interests of the child in mind.

he is close enough that the courts would let him decide, what does the father say? if he will let the boy stay at your house, dont worry about it, even though the papers say he is custodial parent, if the cops are called they have to go by the divorce decree,

he is old enough to tell the courts where he wants to live by the age of 13, he is almost 18,

talk to the father, see if he will let him stay with you, get a paper from him stating this,

I would start out by contacting his father and finding out what is going on between them, is your son playing both sides trying to get something his way? I would start out by trying to work it out in a non argumentative way between the three of you. At your sons age, he can probably decide where it is he wants to live. But I feel that you and his father have to work as a team and try to fix whatever problem there is between them.

always get it done legally. your sson is of age to request a change in custody on your behalf. Go to your family courts and have the magistrate file the papers
