Huge difference, one you are still married the other you are not.

There is no reason to go through the expense of getting legally separated, might as well file for divorce instead. Once you file you are legally separated anyway.

If your married and just decided to go your separate ways and did not file for a legal separation, he could be entitled to anything you may acquire during that time. Legal separation will protect you from that happening. Based on the time limitation of your state, it could be for a year. Most states that require you to file a legal separation require that you be separated for one year before granting a divorce. In the end, you pay for both.

A divorce is a legal end to the marriage union.

A separation is just two married people deciding not to be together anymore, but still, legally, being married.

I'm no lawyer, but my understanding is if a married couple are not living together they are separated. This is usually a "space" thing and gives both parties a chance to get organized for the next step - which is divorce.

Some marriages go straight for the big "D" even while they are living together still.

a seperation is basically taking time apart and doesn't cost you a thing... where as a divorce costs you a lot and makes it official.
