Then it is saying "Flinchum said Wednesday that the gunman, Cho Seung-Hui, had been accused of stalking two female student in 2005 and had been taken to a mental health facility that year." Doesn't the Brady Law say it is illegal to purchase a gun if you are mentally imcompetant by being sent to a mental health facility?

If so how was he able to bypass the background check, unless the medical files were withheld?

I didn't hear that he was sent to a mental facility.

They interviewed the seller of one of the guns, and he said that Cho Seung-Hui had all of the proper documentation required, and when he called the State Police and ran his ID, he came back clean. So obviously, there were no charges brought by those being stalked, or by the state, and his time in the mental facility was of his own accord - not a part of a sentence or mandated by any court in exchange for charges being dropped.

No law is going to stop criminals from committing crimes with guns - no matter how tough we as a soceity makes them. It is up to individuals to make sure that guns are more secure, and maybe we need to give thought to what we deem acceptable requirements for aquiring a weapon. Maybe there needs to be more requirements met, or a longer waiting period, or maybe even some sort of standardized test. Professors stated they knew something was not right with him due to his writings. A specialized test would have sent up this red flag. They have them for police officers before they are hired, and it tends to weed out those that are mentally "unstable" or have a pension for violence. Something like that may be the way to go.

I know that those for the NRA are not going to like me, but I DO think everyone has the right to bear arms. But lets not put them into the hands of the ones that have floated under the criminal radar, only to have them kill 32 innocent people due to their own depression and unhappiness.

Yes, it is illegal for him to buy a gun and it illegal for a Felon to buy a gun. But, They do!!!!!
The Gun Dealer can only verify the person is of age and take down their Personal information. Then it would be up to ATF to check the person's records. Which, I not sure a mental institution release due to confidentiality.
Story; I went to an Auction as it was within walking distance and I had never been to one. I went and signed up to bid. Real fun. But, when the Auctioneer got to the guns this is what he say; "IF, ANYONE here is a Felon you know you can not buy these guns. IF, you a Felon and you buy one of these guns, I will prosecute"! "Do not bid on these guns if you are a Felon"! That about all he could really do, it not like he have a book with all the Felons listed. Now one day and maybe soon. People will be able to check maybe on the Internet. But, I really not know the law on that as to giving out a Felon's Record. We have to question their Right to Privacy! :-(
But, maybe people can Research this and if that the case, write your Congressman and have it changed!

Accused but not convicted, therefore nothing on his report.

Sent to a mental health professional for interviews, but not to a facility. Possible malpratice lawsuit against this person.

The Brady Law does say that, but nothing would have shown on his record to tag. More important is the fact that a student, who is licensed to carry concealed weapons by the state of VA, was disciplined and prevented from carrying on the campus. If more students had been armed, less would have died.

I'm not familiar with the specifics of the Brady Bill and I don't know when this guy bought his gun(s) but I did hear that they were purchased legally.
My assumption was that he had obtained them illegally but apparently that assumption was wrong.
I have also heard that he had meticulously planned this rampage. He was wearing a ballistic vest and he had brought chain to secure the exits/entrances of the building.
Clearly this man was very unbalanced.

Virginia has some of the loosest gun laws in the country. Many of the illegal guns taken off the street in NYC come from gun shops in VA. I enjoy my second amendment freedoms, and I think other people should too, but we do need stricter enforcement of laws we already have. If the gun store did something he wasnt supposed to, then he should be punished for it.

Do we know what "taken to a mental health facility" means? he could have just gone in for counseling; that's not the same as being declared incompetent to stand trial due to mental disease or defect (where a background check would show up.)

Yes and yes. Yet it was not determined that Cho was incompetent. He gave warning signs but ? Nothing really worked in his case and that must be looked into. He got the guns at the same place twice and he was cleared because he had no felony criminal record. Every piece of this puzzle will be examined.

The families of the victims can probably bring a strong lawsuit against the gun companies due to this fact.
