my girl friend has just turned 18 in February of this year, she has attained her green card when her stepfather became a citizen through neutralization couple years ago. My gf has been abused severely by her mom and her step father physically and with words and decided that she needs to move out. Her mom is threatening my gf saying that she would cancel her green card if she moves out. is that possible?

Green Card will not get cancelled! She already has it so it wont be taken away unless your girlfriend commits a serious crime, gets sentenced and a Judge signs a court order to send her back to where she came from! In the other hand, your girlfriend's parents should be the one worried because if your girlfriend reports them for the physical abuse and decides to press charges they are facing possible probation or worst, incarceration. Your girlfriend should seek assistance if she needs it, move out, get a job and wait for the 5 years to file for her citizenship.

Her mother cannot cancel her green card. She has the same rights as any American. If they abuse her, she can report them to the authorities. To be deported, she would have to commit a serious crime (felony) go through the courts and a formal deportation procedure. The question you should ask your g/f is this: Does she actually have the green card in her possession, or did they just tell her that they were applying to sponsor her for one? If she does not yet have the card, then she could have a problem. She should also find out the legal age in the state where she lives. If the age of consent is 18, then she can move away from them, with the green card in her possession of course.

No one can 'cancel' someone else's green card. Only the US government can do that, and even then will only do it if we see that the card has been acquired illegally or through fraud. Since that is not the case with your girl friend, no one can take her card.

At 18 she is considered emancipated in every state in the US and she is perfectly able to move out, start her own life, AND keep her legal residency in the US. When she has had her card for five years, she can apply - entirely on her own - for US citizenship.

greencard means you have permanent residence, even if your card expires you still have permanent residence status, a greencard holder with an expired greencard is like a us citizen with no passport, just re apply, you wont break no law by not renewing your greencard, you will just find it hard to proove your immigrations status, which is needed for getting a job, credit, car, license them things. The USCIS consider an adult to be 18 or over, so when the time comes around for her parents to file to renew her greencard(happens every 10 years) your girlfriend will have to do it herself anyways.

If she was born here, there is absolutely no way that can happen. Yet even if she was not born here she probably can't either because she is what is called Naturalized. That means that she is naturally a citizen, even not on paper. Basically it means she would not be able to live naturally anywhere else. So she will not get deported or anything.

I don't believe so, since she's over 18. Have her call a lawyer who specializes in immigration cases and ask; most lawyers will give that info over the phone for free.

she's 18; she should be ok; tell her to call the immigration/USCIS phone number; they are actually very helpful.
