My mother is going through problems with her husband. He is a U.S. citizen and she isn't . He is an alcoholic and a addicted gambler. He has not help her with anything and they've been married for 7 or 8 years. They both have 2 kids who are U.S. citizens. My mother also has 3 other kids with my father who are also U.S citizen. So now my mother doesn't have her citizenship and he is threatening her that he is going to deport her. Is there any way I could try to petition her? Or is there ways to stop him from blackmailing her? I am her son from another marriage would that be a problem?

You haven't mentioned your status, nor your mother's.

If you are a US citizen, you can petition for your her. However, if she is in the US illegally, she might not be able to get the immigrant visa no matter how long she has been living there. If she is in the US legally and has a green card, she can apply for citizenship on her own.

You say that she is not a U.S. Citizen, but does she have permanent residency (green card) or any other legal status? If she has permanent residency, no problem, after she has lived in the U.S. for 5 years she can file for citizenship if she wants.

If she is here without status (i.e. an illegal immigrant), then she would have to return to her home country before being sponsored by someone else for immigration, and her illegal status may weigh against her. Best to consult a lawyer experienced in immigration issues to find out the facts.

Vanessa, nice name for a boy. Yes, tell her to stop having kids by US citizens, and go back home, file legally for citizenship, then she want have to keep having anchor babies by two US citizen, who probably had no intention of getting her legally here in the first place. Her problem she caused herself, if she had came through the legal process, all these things would not be happening now. Call immigration, they should be able to tell you the legal end of her situation and what she can and can not do.

I feel sorry for her but she has a major problem! Sorry, but she's a criminal for being here. I don't know what to tell you. She must start the immigration process in her home country. She can't become legal if she is currently breaking the law.
