Hold on to them. If the IRS needs them, they will send you a notice. You will not be penalized for late filing just because you forgot to attach the W2s, although it may cause a delay if you are expecting a refund.

Federal or state taxes? I didn't send in a W2 form with my tax return either on the advice of my tax preparer so maybe you don't have to send in your W2? You can always call the IRS and ask:

I don't think it's a big deal. If you file electronically you don't need to attach W2s. The Social Security Administration already has copies of your W2's and the only real problem is when what you report doesn't match what they have.

You will need to amend your original tax return to include this W2 information. Use Form 1040X to file an amendment. I recommend waiting a couple of weeks for your original return to process before filing your amendment.

Here's a secret:
The IRS already has them!
The only reason you need to send them in is so they can see how you arrived at your calculations. They don't actually need them, and you're not going to be penalized.

There will be no penalty. Don't do anything. Wait for the request and then send it in. Any other action will just cause a mix up.

I efiled the federal, but did the state paper form (New Mexico) and forgot to send in the W-2 with the New Mexico return. Any idea what I should do?

A few years back, I turned them in around december or so, I was due a refund, so I wasn't penalized. Hell this year I haven't even started mine.

Just keep it in a safe place, the IRS will definitely contact you for a copy if it so requires. No problem.
