I am due to recieve a refund but have not yet recieved my W2 do I have to file an extension or can I just file as soon as I get my W2. The form to get an extension seems as if it is made for when you owe taxes and I do not.

If you are certain that you don't owe additional taxes you don't have to file an extension. You have 3 years to file and obtain your refund.

Yes, you do need to file an extension.

Also, your employer is going to get in trouble for not having you your W2 by Jan 31.

Legally, you have to file for an extension - but if you have a refund coming, there isn't any penalty if you don't.
