I submitted my tax forms yesterday morning, but it still says status pending (though they have been transferred to the states and fed. gov)... if they are NOT accepted, do I still face a penalty? What would make them not be accepted?

I spoke with the IRS. It's the Acceptance by IRS date that matters not the transmission date. They also didn't sugest I send a paper version tonight because if the e-filed gets accepted the IRS will have two tax returns and it will complicate things for them (how, I don't know).

We're stuck playing the waiting game...

If the return is rejected by the taxing authorities you have NOT met the deadline. You would need to file a paper turn by the midnight deadline tonight.

For this reason it's not wise to e-file this late in the game. If the reject comes back after the deadline, you're stuck with a late return. You might be able to get the IRS to back off of the penalties but why hassle with it in the first place?
