There was not anyone around at the time I was picked up. I was nowhere close to my vehicle and I was not endangering myself. I got tired walking to a friends house, sat down, and eventually fell asleep. A cop woke me up. He didn't cite me then and said he would mail a citation.

there is no action for it if you were only sleeping at the street on your own. you were not driving either. i think he was only trying to bother you coz he can not get drunk :)

each and every state differs from criminal regulations. A Public Intoxication fee states: if he/she looks in a public place below the effect of alcohol, narcotics or different drug to the degree that he endangers himself or yet another person or components, or by using boisterous and offensive habit annoys yet another person in his place. No field sobriety attempt mandatory for the fee of public intoxication.

You were drunk and you were in public therefore you are guilty. Try an AA meeting where I am sure there are plenty of folks who will be more than happy to explain it to you! Good luck---
