I walked in on my boss while he was on the toliet. He was using the ladies room and did not lock the door. It's quite disconcerting and he has not acknowledged nor apologized. I'm wondering if I should take action.

He was likely in an emergency situation and could not wait for someone else to get out of the men's room. So rushed was he to get to a toilet, he failed to take time to lock the door.

No one in his right mind would acknowledge a situation so embarrassing you both. And I'm unclear why you think he should apologize for you barging in without knocking while he was on the toilet?

Just let it go. It's not worth your job nor the hassle of everything else that would go on with attempting to file some sort of action. Plus...I've used the guy's bathroom before when the line in the womans room was a mile long...

I can't count the number of times I've seen a woman use the men's room because the line was too long for the ladies room. Get over it.

I would let it go.

Like someone said, how many times have women used the mens room when the women's was backed up and the mens were totally empty?

He's probably as embarrassed as you.

You should seriously let it go. Its not a big deal. You could have knocked before entering anyways. He didn't do anything wrong... he was just using the bathroom!

Plus he's your boss.. what can you really do about it?
