Ah ... It would be FAR, FAR a better thing for you to STAY in your parents' home and GET an EDUCATION FIRST -- especially since the difficulty with spelling is apparent (emancipated is the way to spell this word -- and by the way, it means to terminate parental control over an individual -- normally this happens when they are ACTUALLY ABLE To provide for all their own needs -- you know -- a job, pay bills, make your own food, put a roof over your head, pay your utilities, etc etc etc)

13 is far too young and incapable of being emancipated. If you are having serious problems at home, seek another family member that you may be able to stay with. For your own sake, don't go living under a bridge, as that is what would happen to you or worse. Deal with it, seek help from your school counsellor or other adult. Tell it like it is. We all go through these feelings at your age, but legally, morally and for the sake of street smarts, get through this trauma.

Can you financially support yourself? Get yourself medical insurance? If not, then no. You can ask the police to remove you from your parents home but you must have a very good reason. My friend got custody of her sister. Her sister was only 11 when she called 911 and told police she didn't want to live with her mom anymore. The police came to investigate. They found that her mother was drunk. They removed her and took her to her grandma's house. The mom lost custody for 6 months and mandatory detox & parenting classes. She moved back in once this was complete. Her mom went back to drinking. Kid called 911, they came, found her mom drunk and removed her. She then asked her social worker if she could move to another town and live with her sister. The CPS had to approved her sisters home 1st. She's been there for 3 yrs now. Good luck

in order to be a emancapated you have to convince a judge you can survive on your own in the real world and no 13-year-old can do that.

If your having trouble at home first talk to a counselor or a church pastor. They might be able to help you, but I did hear that once your 11 you can choose to live with one parent or the other if they are divorced. On the other hand if its both parents your trying to get away from just maybe you need to sit down and talk, and I know that's easier said than done. If your being abused talk with social services. Good luck

Yes. However; there generally has to be a very good reason and you generally also have to show enough maturaty and self sufficiency to a judge. The laws vary from state to state; but, it is generally not easy to do. Mind if we all ask you why you are contemplating this legal action?

why do you ask? i really think things cant be that bad!!!if you are being abused sexually, or being hit, or something like that then you need to call someone or let an adult know, you dont have to do try to divorce yourself from your parents.
