My brother in law got married 2 months ago; now getting divorced. No children involved. She quit her job and would always complain he wouldnt give her an allowance, then she would say she would pay the gas bill for example then spend it on getting her nails done or something. Anyways not good from the get go. They are not living together now but she came over and was throwing his things around in the house and screaming. My Bro in law left then she called the cops saying he hit her and when the cops got there she had injured herself and is now blaming him for it. she was not injured when he left. Will my brother in law get in trouble or can he file charges on her for lying? And her father is threatening to kill my in law.

OK first how old are they, if they are under 25 they are to young to be in a serious relationship let alone married. Second your brother could be lying to you and saying that she injured herself which may not be the case. But assuming he is not lying to you he could not get charged with anything because he did the right thing and left the scene and called 911. She can be arrested for what in Washington state is called Malicious Mischief. The father could also be arrested for threat. If she file charges saying that your brother injured her and it was not true then he could have charges pressed on her for lying to police or making false or misleading statements.

I am sorry for your unfortunate situation. Unfortunately, it is her word against his. Since she had a visible mark, the cops have grounds to have him arrested, wether he did it or not, which it sounds like he didn't. That doesn't necessarily mean that he will be convicted of it though. If he does have a hearing, his lawyer can request a continuance until further evidence against her can be obtained and he can be cleared of any charges if the judge sees necessary.

I would advise your brother in law to get a restraining order against her and her entire family. MAKE SURE HE DOCUMENTS TIMES, DATES AND WITNESSES TO ANY HARASSMENT BY HER OR HER FAMILY.

His best bet would be to hire a very good lawyer. Sounds like she is one loose cannon! Good luck to your brother in law and your family and with any luck, the right person will get punished in the end.

i am afraid in the case of the woman receiving an injury then it is a case of her word against his. having said this it is very difficult to injure ones self to the degree that it looks as if the injury was caused by another party and such accusations can be quite easily proven to be inaccurate (for example if a weapon was allegedly used then you bro-in laws finger prints would be on the weapon in question-the police would look at this). if she went to his home causing a commotion then it may be worth asking neighbours etc if they heard anything even if they heard her creating-if they never heard anything resembling an attack of any kind this would help your mans case. he should get a good attourney . he should also inform the police of the woman's fathers threats.

You should speak up to the cops about what you know about her doing it to herself, and if you know her father tell him as well that she hurt herself, those are serious charges, and he should not have to go thru that. Women like that should be put in jail, and wear something like the Scarlett letter, but the letter "L" for liar so other men know what she is.

Unfortunately this sort of thing happens all too often. If he has witnesses who can support his story, he'll probably get off. If not he can only hope that the woman in question is unable to convince the judge.

Contact an attorney. That situation is terrible. I'm sorry for your entire family. My suggestion is to have him contact the police immediately and get his side of the story in. Good luck, my prayers are with you.

Two whole months?. They were never really married, they just went through the motions. It appears they didn't have any sense when they got married, and don't have any sense now. Here's an important legal term, GROW UP!.
