I have been waiting on the divorce to go thru since Dec. 2005, but it took a whole year and was final April 2007. If I file married, filing sep. I will owe so much, how can I file single?

If you can prove that you didn't live together the whole year (2006) you are legally separated from your (ex)spouse, then you can file as single. If you have qualified children as dependent, then you can file as Head of household.

Otherwise, Married Filing Separately is your only choice.

You can't unless you were legally separated under a decree of separate maintenance - if you think that might apply to you, check with your lawyer, since state laws vary. You aren't legally separated under a decree of separate maintenance just because you didn't live together all year.

If you have dependent children living with you, and pay more than half of the cost of keeping up a home for them for the year, you can probably file as head of household - otherwise your options are a joint return or married filing separately.

Yes, you can file as a single.

*edit* Sorry it was my understanding that with a "Dissolution of Marriage Agreement" (divorce papers) it would not have to be finalized to file single. It should also outline who gets to claim children if any...but maybe I'm wrong.

Why don't you file Head of Household? Do you have any dependents?
