when doing a malpractice suit...our attorney quoted a certain percentage. does this percentage include all the travel expenses to get depositions from other dr.'s in different states, or is this an addition to the percentage that we were quoted. this has been going on for almost 3 years. is this ever gonna end???!!!!

Some attorneys are percentage only, it we don't win, we get nothing types. Most are expenses, plus a percentage if we win. It should have been discussed on day one when you signed him up. If you don't have it written down somewhere, just ask.

3 years? You are just barely started. Anytime an attorney is involved it always takes longer. Look to 5 to 7 to get any satisfaction.

Kelly, No matter what happens the attorney gets ONLY the agreed upon percentage no matter what his office does or how far they are required to reach for the information they need.

My wife and I were involved in an automobile accident with a drunk driver from another state. Fortunately the accident happened in NY. where we live. It took 3.5 yrs. for her insurance company to settle out of court. Hang on this nonsense takes time.

Another time I was bitten on the forefinger by a stray cat. I was infected by a disease called Pasturella Multicedia. Cats carry this rare disease. With out quick intervention by a local veterinarian the I'd have been dead in 7 days. One particular antibiotic saved my narrow butt. The owners of the stray cat came forward and claimed it after it was removed from our cellar. That case lasted 5 years.

In your case It may take somewhat longer because of the complexities of your case. I promise you all the time in the world will be worth it to you and your family. Good luck to you!

You should ask your attorney since that is the person you retained, or read what you signed. It can vary.
Malpractice suits are very costly for attorneys and often they ask for more than the standard 33% the typical bottom feeders take for car accident and animal bite suits

You should have an written agreement as to what is included in the percentage.

It ends when your lawyer has ALL of the money.
(I hate lawyers....)
