I called the IRS a few days ago about this. I asked if the IRS owed me money do I need to file and extention if I needed more time. I was told I did not need to as long as I was absolutely sure they owed me the money. If it was the other way around and I owed them there would be a penalty I would have to pay. So if they owe you you can still get your refund but of course you will need to file first.

Yes. But you won't get any refund until you file.

You can only get your refund if you have filed your 1040!
