my son want to move in with his father i was wondering at what age they could choose what parent to live with

in pa they can at any age if they past a pysch exam

First of all, you need to check with your local state's laws regarding when a child is of the age to choose where they want to live (and the court will actually listen to their testimony). You can find this out by talking to either a family law attorney in your area, or any child advocacy center (or place where visitation is supervised).

That said, at about age 12, a child is considered aware enough to be able to choose where they want to live .. and that is when the Courts (namely the Judge) starts to listen to their input.

One of the things to consider is this -- WHY is the child saying that they want a change at this time ... is it because they KNOW that they have DIFFERENT (and ... most probably lax) 'rules' or 'parental supervision' in the OTHER parent's home? Is there something going on that makes your home less desireable for the child to live in?

IF the first -- look out in the near future -- for as they age through the teen years .. then you could experience a LOT of problems when that child returns to your home for Visitations -- crimes, burglary, objectionable behaviors, and other difficulties ... (believe me, I know .. whenever my own two had contact with the abusive, violent, sociopathic ex -- their behaviors got WORSE -- and I had to call the police and make sure that they got mental health treatment and GOOD parental Rules that I DID NOT back down from).

IF the second .. maybe it might just be better for the child to go to the other parent at this time until your situation stabilizes so that you can provide a stable home environment for the child.

Actuially.. it depends on the country you are in...

In my country the age of 9... he can opt o choose where to live. Hoever he has to be accompanied by a legal counsel appointed by the court of law that he is not being pressurised to choose which parent he wants to say.

This counsel will consists of a panel of lawyers and acting as the boy's guardain and has all the thoughts and benefits of the child...

check it out with family lawyers.. ( I mean specialised ones..) they will know better..

It depends on the state that you live in. And his age.

I believe it is 13 but you have to check with the Family Court of your state.
