Just wondering if i can claim my brother as a dependent? He lives with me and i provide more then half of his support. He's a college student, however he does own a business which is at a loss. Can i assume if his business income is less then 3200 i can cliam him as a dependent. And if so does he have to file a separate return for his business losses, thank you.

Yes. But you should be prepared to prove that you do in fact provide more than half his support.

Is your brother under age 24 as of 12/31/2006? Then as long as he did not provide over half of his own support, and he lived with you for over six months in 2006, then he is your qualifying child.

If he is 24 or older, he can be your qualifying relative as long as you provided over half of his support and he did not make $3,300 of gross income from his business (before all business deductions are taken).

If he is living with you and you are paying for his needs, then he is definitely your dependent. He will still have to file a return, just as you would still have to file a return if, for instance, you were shown on your parents' return as a dependent.

Make sure no one else claims him as a dependent. (parents, legal guardian(s), etc)
