It depends on the state but this is how is usually is...infant carrier until 20 pounds, 5-point harness seat until 40 pounds, and booster seat until 80 pounds.

Kids should sit in a booster seat until they can pass the "five step test" in whatever vehicle they are riding in:

The 5-Step Test.

1. Does the child sit all the way back against the auto seat?
2. Do the child's knees bend comfortably at the edge of the auto seat?
3. Does the belt cross the shoulder between the neck and arm?
4. Is the lap belt as low as possible, touching the thighs?
5. Can the child stay seated like this for the whole trip?

Please keep your child as safe as possible for as long as possible!!

It is a combination of weight and height I do believe. However there may be different rules in different states.

I would check with your local car insurance company, or better yet your local police department to get your area's specific guidelines.

I would also consult your pediatrician to see if the state guidelines follow what THEY recommend. Some state laws may be a bit more lenient then the AMA would like.

I live in Idaho and it was changed a couple of years ago to everyone under 7 years old, there is no weight restriction http://www2.state.id.us/phd7/Current%20News/2005/July/New%20Booster%20Seat%20Law.htm . Before that it was 4 years and 40lbs. You should search for your state's law by searching for "{your state} booster seat law"

depends on your state. In NC its 80 lbs or 8 years old - whichever comes first. Its recently been changed here. It was 60 lbs I think.

In Indiana It 7 yrs old, and 70-80 lbs. I put my daughter in one, but I feel she is far too big to have to be. She is 6. She cries and says shes too old. I agree.

We tell them to grow up, and then make them sit in a baby booster. Doesnt make alot of sense. I think 5 yrs old is old enough. Also make sure its hooked in right if its not its the same fine.

I personally never wear a seat belt, but i do make the children. I can see them regulating children but adults should have the right to choose.

40lbs and 4 years of age in most states. I do think it is recommended to keep them in a booster seat until they reach 48" but that is not a law.
