I am residing in a foreign country and do e-bay there. I am not allowed to work in that country so I have a US account. I am not a US resident but intend to file US taxes for my American e-bay account. Since I am not a US resident, I do not live in any state. So am I exempt from state taxes for my business? Conversely, if I do have to pick a state, does that mean I qualify for resident benefits from that state, such as WIC and being able to claim my daughter is a resident of that state, although we are not US residents? If I have to pick a state, I want state benefits.

The question that comes to mind is your citizenship. If you are a US citizen you would be required to file a US federal return. If that is the case you are not a resident of any state and therefore would not be able to claim any benefits. Some states such as South Dakota and Texas have very liberal residence requirements and they would be the easiest to establish residence in. But only if you are a US citizen.

No, you don't have to file a state return if you don't live in one. And you aren't eligible for benefits from a state you don't live in.
