My son was charged with a sex crime...turns out girl wanted her boyfriend jelous....we went thru a year and a half of court dates ,alot of missed work and school and we had all the evidence to prove she lied right from the beginning( school security tapes....her friends statements...even the boyfriend new it was a lie....but we still had to go thru all the court dates. WHY is it that we were ion court every month and she never once had to step foot there. Is there anything that can be done to her now? and who do I contact ? I would like to know why it is that " YOU ARE GUILTY UNTILL YOU PROVE YOURSELF INNOCENT" any help would be appreciated ...thanks

I would talk to the police and the D.A. She can be charged with making a false police report. I think that you should pursue that angle. Sex crimes are very serious and I think that when false allegations are made the person who made them should be prosecuted. Unfortunately, with sex crimes, it boils down to he said, she said and it is often hard to prove who is telling the truth. When someone is convicted they have to register as a sex offender and are marked for life. My husband manages a furniture store and he does all the hiring. If someone has a conviction for a sex crime, he cannot hire them. He can hire people who have committed crimes but not a sex crime, no matter how long ago it was and no matter what the circumstances were, because his employees have to enter houses to make deliveries. Had your son been convicted it would have changed his life forever. I would pursue the crime angle first and then I would try to sue her.

Im in Australia and wouldnt know the laws and how they work all over the world but I would think you could sue for deffomation (ruined your sons good name) but if you have been through all that court wouldnt you have someone advising you? If not I would contact a solicitor and let them tell you what you can do.

Something similar happened to my husband - he was accused of raping his then girlfriend - when it got to court he was able to prove he was not even in the state she was in at the time so it was impossible that he could have done it - the court then looked up her previous complaints and apparently she had accused her previous 2 boyfriends of the same thing and it was just tossed out of court. He didnt take it any further but was only abour 14 at the time.

Ask your son if he really wants to take this any further - you sound by your question that you have really had enough of the whole issue - its been long and drawn out - you sound angry and understandably so but do you want to keep drawing it out or do you want to start just living life again? Something to think about anyway but I would ask your son what he wants to do.

You can try but false prosecution is one of the hardest to prove. There is all kinds of safety nets for accusers. I believe I would try, that is if she has anything worth suing for. Remember, if you sue her, you are going right back into court. More time and trips in and out. Innocent until proven guilty is a complete farce - you must prove your innocent once you become a suspect.

How much time did your son spend in jail for this? Didn't think so. That's where the innocent until proved guilty part comes in.
But anyway, yes, you can sue for defamation of character, and slander, and you can sue for the actual cost to your family in lost wages, travel, etc., and you can sue for punitive damages as well.Of course, since she is also innocent until proved guilty, be prepared to prove that she actually lied for her own gain (boyfriend's attention).

You should sue for slander - go see a lawyer.

Have you been following the Duke LaCrosse team's false rape allegations? They are going to sue too.

You absolutely need to sue this girl - and everyone else who knew this was false yet helped keep it going. You need justice for what they all did to you and your family.

Be careful of lawyers though - don't pay them anything up front - have them work on contingency of no more than 30% of the total settlement.
Don't be afraid to shop your case around.

DAs are political animals. Just like Nyfong in the Duke scandal. Yes, you can sue the gal for civil damages. Criminal charges would have to entail intent on the DA's part to make a case, and that is not very likely.

Get your lawyer to sue her for slander. If the school security tapes proved your sons innocence, sue the school too!

welcome to the world of our legal system. We are supposed to be innocent, till proven guilty.
You were run through the system, because you didn't have the funds to buy your way out. If you had a savy lawyer, that was actually interested in earning his money, you would have won, and been done with that mess as soon as the evidense was revealed.

Now your son, will have a label on him now, making his life a bit more harder to live out.
