You need to have proof of their noncompliance. If you have nothing in writing from either yourself or them, you have no papertrail of your attempts to deal with them. And, would severly limit the facts of your case.

Instead of calling them, send letters. Send them certified mail return receipt.

Keep your letters to the point and factual. When writing your letters ask yourself - what would a judge like to see or if something you include in the letters could work against you in the courtroom (untruths, angry raging, threats, etc.)

You might start your first letter to the card company by re-capping what you had previously done by phone, including the date you first started calling them. Be truthful in what you say.

Check any contractual information that they may have provided you. Find out if they had violated any part of their contract by failing to send your money in a timely manner.

Generally small claims is the cheapest and easiest court to sue in. Many, if not all, states small claims courts limit the dollar amount up to $5000.

If you plan to file, you would be doing yourself a great favor by reading your states small claims court rules of procedure.
