she would put money into a trust fund for their birthdays and on holidays (like christmas and easter...) every year since they were born. she passed away when they were17 and 15. now, after they came of age to receive the money he told them he got it and spent it. saying he had to use it for them at one point or another...he took it for himself!

my "EX" husband, and he lives with a new wife with 3 kids. he's still a looser and jerk (to say the least, that's why i divorced him)...i don't want their money, and it didn't belong to him either.

Who is "he"?
A lot will depend on the terms of the trust fund(s). Were they in the kids' names? Was something written in grandma's will about this money going to her grand-children? If so, and someone took the money unlawfully and spent it, then you can sue him for it and he has to pay it back. But as I said, you'll have to have some proof.

i thought that trust funds can't be touched by anyone except the person whom it is for when he/she reaches the right age.

well if it is true that he was able to use the money, there's nothing you can do about it anymore. maybe he needs it for his burial.
