You probably have to because Microsoft will not allow you keep the same OS because they are afraid of piracy and people stealing their product key. However, you can reinstall it on the new hard drive and read the old hard drive though you will have to register your operating system, which is a pain to do at time. Of course the other option is transfer all your files by using file transfer wizard in Accessories. You can also back-up a certain amount of your documents and setting by mozy up to 2.5 gigas and then restore them afterward. You can also put the files on CD or USB flash-drive if you really want to get down to it. You will still need to register and reinstall your operating system though if you put on a new hard drive.

IF it's your Boot Drive (C:), then probably. But check the docs that come with the drive. Many companies these days provide a CD and instructions to clone your old hard drive to the new one, thus avoiding having to reinstall everything.
If it's not your boot drive, then no, there shouldn't be anything to reinstall unless you for some reason installed programs to it instead of the standard boot drive. You have to actually try to do that, so if you haven't, you're fine.

If it is your system drive, yes. Legally if the OS is removed from the old drive you can install the OS with the same key on a new drive.

Yes you will need a Windows 98, Windows ME or a Windows 2000 disk to load before you can load the XP upgrade. Go to a local computer shop. They usually have several old copies laying around.
