It really depends on where you live. You need to consult your local health department to be sure. Just call them up and ask them.
When I worked in food service in Minnetonka, Minnesota, it wasn't ok to wear nail polish (although I'm a guy so I didn't care). Sounds like maybe you're catching some flak from your manager for this? If so it's important to remember that whether or not it's illegal in this case is irrelevant. If your manager has a policy forbidding nail polish while working, then you're probably better off just doing what he/she says. Remember, they sign your paychecks and when you're on the clock then you pretty much have to do what they say. Skipping out on the nail polish doesn't sound like an unreasonable request.
Nail polish can flake off and end up in somebody's food. At best this creates headaches for the manager who has to deal with the complaint and the cooks who have to re-prepare the food. At worst it can create a lot of legal liability due to lawsuits from customers who may accidentally ingest nail polish flakes.
My manager tells me I can't wear shorts to work no matter what. I don't work with customers at all, and am never seen by anyone except my coworkers. It's not the law per se, but he's the boss and that's company policy so I wear pants to work, even when it's over 100 degrees outside. C'est la vie.

I was a waitress for 2 years and it really depends on the place and who's in charge. The first restaurant I worked in was pretty laid back and casual, i was allowed to wear nail polish/have fake nails/wear my facial piercings etc. But the second one I worked in I wasnt allowed any of that (mind you it was a big hotel....pretty strict uniform rules) Yes it can chip off, but the chance of it going in the food while you're carrying it? Not likely I dont think. It can't be that harmful if a tiny bit was swallowed. Think of the people who probably still bite their nails when they're wearing polish. So basically there's not one universal rule. It's all up to your boss and the type of place it is. Hope that helps! :)

LOL, no! But it definitely projects a better image for the restaurant if her nail polish is fresh and not chipped. Also, some restaurants may have a dress code about colors of nail polish you're not allowed to wear or something, but I see lots of waitresses with nail polish AND fake nails!

As far as being legal, that would be defined by the state or local health board.
I certainly wouldn't want chips of red polish in my food or beverage.
When I worked in the food industry years ago, I was told that I should keep my nails short and neat, and wear clear polish only.
Colored polish looks great, but not when you are near food preparation in any way.

I don't think it's illegal, per se; but I work at a 'country fresh :)' national chain restaurant and the only fingernail polish we are allowed to wear is clear or very light pink. However, I have been to many other restaurants where servers are wearing many different shades of polish. I think it just depends on the restaurant - each one has different policies regarding personal appearance.

From my experience in Food and Beverage positions... by Health Dept codes, anyone working with or around food is not allowed to wear nail polish.

o.o idk about waitress but in the kitchen they definetly dont allow anytype of nail polish. Maybe it's the same for waitress too.
oo to be on the safe side just wear clear or white or a light color nail polish so they dont notice

That is the link to the Food Code by the FDA and in the 768 page documentation on the laws, page 82 clearly states:
Fingernails 2-302.11 Maintenance.
(A)
FOOD EMPLOYEES shall keep their fingernails trimmed, filed, and maintained so the edges and surfaces are cleanable and not rough. P
(B)
Unless wearing intact gloves in good repair, a FOOD EMPLOYEE may not wear fingernail polish or artificial fingernails when working with exposed FOOD. Pf
