Legal separation is a contract between you and your spouse and has little or no legal relevance, other thatn to the both of you,
Subphoena? By whom? Please.
You have to go to COURT and file for divorce or spousal maintaince and child support for your children. You have to hire a lawyer and request the judge to allow you to look into to his income to set an amount to pay you. If you want more done, then it will be at your dime. You will have to hire a P.I .or an accountant to do this.
Good luck

All of this depends on the state. Anything is fair game in a divorce case. Especially for child support, all income must be reported, or contempt charges can be levied. I would say that the answer is yes...get a good attorney! Although that is an oximoron ;)

All I can say is get the best lawyer money can buy and he will have to pay for it and anything he acquired in the 20 yrs you've been married will have to be split. Make sure you talk with a good attorney who will bill your husband for his fee.

You don't need to file for a legal separation, just file for divorce. There is no reason or need to get a legal separation first before filing for divorce. Once you file for divorce you automatically are legally separated. You divorce lawyer can and will (if he/she is good) get all the info you need to take her to the cleaners.

The only way you can do that is if you file for divorce, your lawyer will do it automatically...also have them do a "discovery" which can find even more hidden assets...maybe one's he isn't claiming on his taxes.

He is going to pay dearly. He has to keep you in the lifestyle that you were accustomed to living when you were with him. The 2 children is going to cost him at least 25% off his net pay. Don't strike no deals with him. You will just allow to get away with what is owed to you...

Yes - they will subpoena your spouse's pay stubs & require proof of any other income she may be receiving to determine spousal/child support.
