I have an 06 R350, which is under warranty. The gear-selector is made of cheap and flimsy material, and snapped when I moved it. Mercedes is saying that it's my fault, but I believe it's theirs, due to their making the gear-selector so cheaply and weak. What process can I use to appeal their refusal, and how would you recommend my handling the situation, and finding a way to get them to pay?

You moved it ? Kinda vague to us , so we can't be of too much help .
Approach the manager with your request , and failing that , take them to small claims court with all your paperwork indicating that it is covered (else the judge will dismiss your claim) .

I tested the R class before and I found the gear selector is small/easy enough to operate, doesn't require huge amount of force to move it up and down. Very unlikely that the gear selector could just broke like that.
I'm not sure how it became broken but if that's really the case then you can try to talk to the service manager. You may applied too much force on that thing or either you were unlucky enough getting the defective gear selector. Otherwise it's rarely happen to see such incident in any MB dealer and that's why they will not take it as their liability.

Contact Service Manager, and if no help contact Mercedes Customer Service if that doesn't work you will need a lawyer which will cost more than the gear selector and they know that.

cheap interior by mercedes? i have a 2000 s430 and the gear shift has a really strong build to it. i didnt test drive the r350, but i would image that it wouldnt cost that much money. you can try to get your car insurance to cover the cost.

relying on the price, small claims courtroom is assistance to cope with this in the adventure that they don't honor their declare. The equipment selector should be harder than that; yet everybody making autos flimsier lately.
