Its not your fault but it is your responsibility

It is considered your fault by the bank because you endorsed the check. Not fair I know, but now they want you to pay the money back and you have to. This is your responsibility. You need to go after the person who gave you the bad check, if it is someone you know well.
There have been many check scams that have been happening like this for the past few years and they are getting worse. If it was one of those, then it would NOT be considered your fault BUT you will still have the responsibility to pay back the money to the bank.

If you went to a same bank that the check was issued on and the teller had the opportunity of checking the account before giving you the money - No, you should not be liable for it, even though that may have been the same bank in which you have your checking account!

But if you merely deposited it into your account - then withdrew money from your account on the basis that you thought the check was going to clear and that check was actually drawn on an entirely different bank - Yes you are liable for the check being bad.

Yes and no. While you obviously didn't know that the check was a bad check, you are responsible for paying back the bank the funds that you have withdrawn. However, you should be able to sue the payor of the check for any fees caused by them writing a worthless check (which technically is a crime).

It is not a matter of fault. The actual fault lies on the shoulders of the individual who wrote the check. However, you assumed that risk when you cashed the check, therefore you have to pay.
