My girlfriend's parents filed taxes claiming her as a dependant. However, because she has financially supported herself for more than half the year after graduating from school, she does not meet dependancy requirements and will file as an independant. What will happen now?

If her parents claimed her and she also claims herself, both she and her parents will get a letter from the IRS asking them to prove who provided more than half of her support. Based on the information each gives to the IRS, they'll decide who gets the exemption - the other person will have to pay back whatever extra taxes are due. This letter will probably come within a few months, maybe sooner.

If your girlfriend moved out of her parents house as soon as she graduated, and hasn't gotten any support from them since then, she'll probably win. If she's still living with them, then they might have a good argument that she didn't provide over half of her own support for the year.

If she wants to claim her own exemption, her parents will have to file an amended return.
Your girlfriend should file for an extension right now, then talk to her parents and have them file an amended return, then file her own return claiming her exemption.

Don't panic, but both parties will likely be audited by the IRS. Try calling them in advance and explain the screw up. They are usually willing to help out.
