Probable cause is such a broad term. It's like describing all the citizens of the world as just "people". The law is written that way purposely to allow an even broader and more generalized interpretation of what constitutes such. Probable cause has nothing to do with evidence. It has all to do with profiling and stereotyping. Why is it that four white guys dressed in suits driving a Mercedes Benz draws no suspicion, no probable cause? But if you have four other than white gentlemen driving the same car with the same attire they get pulled over for suspicion or "probable cause". When in fact the white guys are the ones with a trunk full of Purple Haze and a gas tank full of kilos of coke.

What Does Probable Cause Mean

'Probable cause' is physical evidence that would lead a reasonable person to believe a crime has been committed. Your dissertation on someone changing his/her mind on what happened in a particular incident, gives rise to the reason a police officer, in most jurisdictions, will not arrest someone based solely on what someone tells him has happened. There must be physical evidence of a crime, such as a bruised/bleeding victim, in the case of domestic violence. Where there is only a statement by a supposed victim, that a crime has been committed, the officer will advise the victim to file a report at the police station and get a warrant against the perpetrator from a magistrate.

Kind of a meaningless term.

Probable Cause means that the circumstances and evidence indicate that you probably committed the crime.

Any time someone is arrested or searched, probable cause must exist.

For instance. I pull you over for a traffic violation. I smell booze on your breath. That is the probable cause I would need to get you out of the car for some sobriety tests. You fail the tests; that is probable cause to assume you are too intoxicated to drive and you are arrested.

Here in Canada we use the terms "reasonable grounds" which is defined:

A set of facts or circumstances which would lead a cautious and prudent person to believe, and which goes beyond mere suspicion.

The person was arrested because the officer believed that there was enough evidence that an offence, is being /was being/was about to be comitted and their belief was stronger than just suspicion.

Enough evidence was seen for an officer to arrest a suspect. For example, a traffic stop, if you or your car is searched and the officer finds illegal contraband, this would be probable cause for an officer to arrest you

Basically it means that the police think you probably commitied the crime for which you are being arrested.

This is why we have a Court system in this country to determine whether in fact you are guilty or not!
